User Agreement (hereinafter the Agreement)
This document "User Agreement" constitutes an offer of Joyway LTD (hereinafter - "Joyway" or the Company) to conclude an agreement on the conditions set forth below.
By accessing and / or playing, downloading and / or viewing, opening and / or using the Site and / or the VR Game, you represent to us that you have read, understood and agree to be bound by this Agreement and all applicable local, state, national and international laws. and conventions, including but not limited to all intellectual property laws. The Company reserves the right, in its own and sole discretion, to deny access to any User without prior notice. If you violate any of the terms, including the terms of the Agreement, we may, at our discretion, send you a warning of the violation or immediately close your account for violation of the terms.
If you do not agree with all of these terms, including the terms of the Agreement, do not allow the use of the Site and the VR Game in any way. If the User does not agree with the changes made to the Agreement and other documents, the User undertakes to stop using the Site and VR Games.
1. General Provisions
1.1 In this document and the resulting or related relations of the Parties, the following terms and definitions are used:
Agreement - this document with all additions, changes and mandatory documents specified in it, as well as a contract concluded on its basis.
User/ User's is a capable individual over 18 years of age who acceded to this Agreement in his own interest or acting on behalf of and in the interests of the legal entity he represents.
Site means a collection of web pages located at the domain addresses https://stride.joyway.games/.
VR game is a set of data and commands presented in an objective form intended for the operation of computers and other technical devices in order to obtain a certain result and the audiovisual displays generated by it in artificial reality created by technical means, intended for installation and use on specially designed devices.
Device - a personal computer, tablet, mobile phone, communicator, smartphone, VR helmet, other device that allows you to use the VR Game and / or the Site according to their functional purpose.
Content - images, text, audio and video materials, computer code, illustrations, animation, sounds, musical compositions, audiovisual effects, as well as any other objects of copyright and (or) related rights, as well as information and messages of any nature that are not such.
User Account - a unified system of registration and authorization in the VR Game using the identifier assigned to the User by Joyway or in other information systems determined at the sole discretion of Joyway.
Personal Account - a personal section of the VR Game, to which the User gets access after registration and / or authorization in the VR Game. The personal account is intended for storing the User's personal data, creating a User profile, as well as viewing and managing other available functionality of the VR Game and the corresponding terms of use of the VR Game.
1.2 This Agreement may use other terms and definitions not specified in clause 1.1. of Agreement. In this case, the interpretation of such a term is made in accordance with the text of the Agreement. In the absence of an unambiguous interpretation of the term or definition in the text of the Agreement and other documents that form the agreement on the terms of the Agreement, one should be guided by its interpretation, determined: first of all, by the legislation of the Republic of Cyprus, secondly, by international law, and subsequently by business customs and scientific doctrine.
1.3. The use of the VR Game and / or the Site by the Users in any way and in any form within their declared functionality and purpose, including:
registration and / or authorization in the VR Game using the User's Account;
viewing the content and materials posted on the Site;
posting or displaying any Content in the VR Game;
other use of the functionality of the VR Game or the Site;
creates a contract on the terms of this Agreement in accordance with the provisions of the Civil Law of the Republic of Cyprus.
1.4. This Agreement and the binding documents specified in it now or in the future determine the basic terms of use of the VR Games, as well as any changes and / or addition of new functionalities.
1.5. A required condition for the use of the VR Games and the Site is the complete and unconditional acceptance by the User of the terms of the following documents (according to the text of the Agreement - "mandatory documents"):
1.5.1 Privacy Policy posted and / or available on the Internet at https://joyway.games/privacy-policy
1.6. The provision of VR Games is regulated in accordance with the provisions of this Agreement, as well as additionally accepted documents (in the text of the Agreement - an "additional document"), which are posted by Joyway on the pages of the Site or in the VR Game itself, or will be published in the future and may regulate the specifics of using a certain VR game and / or services in it.
1.7 In the event of a conflict between the Agreement and the terms of use set forth in an additional document to any VR Game, the terms of use of the respective VR Game set forth in the additional document related to it shall prevail.
1.8. The Agreement, including binding and additional documents related to it or drawn up in its execution, may be changed by Joyway without any special notice. The new version of the Agreement and / or mandatory documents comes into force from the moment it is posted on the Site, or in the VR Game, or brought to the attention of the User in another convenient form, unless otherwise provided by the new edition of the Agreement and / or in the specified mandatory documents, or without notice Of the User, while continuing to use the Site and / or VR Games after amendments to the Agreement and other mandatory or additional documents The User is considered to have accepted the changes to the Agreement, mandatory, additional and other documents.
1.9. Using any of the opportunities specified in clause 1.3., you acknowledge that:
1.9.1. Have reached the age of 18;
1.9.2. You have familiarized yourself with the terms of this Agreement and the documents specified therein, mandatory and additional for the Parties, in full before using the VR Games and / or the Site;
1.9.3. You accept all the terms of this Agreement, mandatory and additional documents for the Parties in full, without any exceptions and restrictions on your part, and undertake to comply with them or stop using the VR Games and / or the Site. If you do not agree with the terms of this Agreement, documents binding and additional for the Parties, or do not have the right to conclude a contract on their basis, you should immediately stop any use of the VR Games and / or the Site.
2. General terms of use of the VR Games and / or the Site
2.1. Viewing Content posted on the Site and / or in VR Games in the public domain does not require mandatory registration and / or authorization of the User. But when browsing the Site, you must remember that all Site Content is protected by copyright.
2.2. Any other use of the functionality of the VR Games is allowed only after the User has registered and / or authorized in the VR Games in accordance with the rules established by Joyway.
2.3. The list of functionality of the VR Games, the use of which requires prior registration and / or authorization, as well as the acceptance, if necessary, of additional documents for their use, is determined at the sole discretion of Joyway and may change from time to time.
2.4. Upon completion of the registration procedure using the User's Account, a unique account is created, which can be associated with the User's Personal Account in the VR Game, which is necessary to use most of the functionality of the VR Games
2.5. To register, the User undertakes to provide accurate and complete information about himself on the issues proposed in the registration form, including when registering on the resources of third parties, and to keep this information up to date. If the User provides incorrect information or the Company has reason to believe that the information provided by the User is incomplete or inaccurate, Joyway has the right, at its discretion, to block or delete the User's account, as well as refuse the User to use the VR Games and / or the Site.
2.6. Joyway reserves the right at any time to demand from the User confirmation of the data specified during registration and to request, in this regard, supporting documents (in particular, identity documents), the failure to provide which, at Joyway's discretion, may be equated with the provision of inaccurate information and entail the consequences provided for in clause 2.5. of Agreement. If the User's data specified in the documents provided by him do not correspond to the data specified during registration, as well as in the case when the data specified during registration does not allow the user to be identified, Joyway has the right to apply the measures specified in clause 2.5. of Agreement.
2.7. Information about the User contained in the User's account and Personal Account if such will be created, is stored and processed by Joyway in accordance with the Privacy Policy.
2.8. When registering, the User independently chooses a login (a unique symbolic name of the User's account) and a password to access the Personal Account. The subsequent change of the User's password is carried out using the VR Games software provided in his Personal Account. Joyway has the right to prohibit the use of certain logins, as well as establish requirements for the login and password (length, allowed characters, etc.).
In case of obtaining an account in the Products and / or on the Company's Website through the services of third parties, registration and accounting of Users occurs according to the data transmitted by a third party, but within the framework sufficient for the functionality of the Products and / or the Company's Website.
2.9. The Registered User independently determines the procedure for using the Personal Account and other functionalities of the VR Games, including the terms of use of the respective VR Games, which under no circumstances can contradict this Agreement, with the exception of those established in additional documents.
In case of obtaining an account in the Products and / or on the Company's Website through the services of third parties, registration and accounting of Users occurs according to the data transmitted by a third party, but within the framework sufficient for the functionality of the Products and / or the Company's Website.
2.10. Using the functionality of the VR Games, the User can independently, by his actions, at his own discretion, disclose to an indefinite circle of persons (publish in the VR Games and / or on the Website) information about himself, which may include personal data.
2.11. The procedure and consequences of using the login and password by the User are determined in section 6 of this Agreement.

2. General terms of use of the VR Games and / or the Site

2.11. The procedure and consequences of using the login and password by the User are determined in section 6 of this Agreement.
3. Restrictions on the use of VR Games and / or the Site
3.1. By accepting the terms of this Agreement, you understand and acknowledge that:
- Joyway has the right to set limits and restrictions on the use of VR Games and / or the Site and the Services based on them for all Users, or for certain categories of Users (depending on the User's location, the language in which the Service is provided, etc.) , including: the presence / absence of certain functions, the maximum storage period for information and data, special parameters of the loaded information, etc.
3.2. Information about the established restrictions will be brought to the attention of the Users in the form and in the manner that are determined at the sole discretion of Joyway.
3.3. Unless otherwise provided by additional documents for the use of a separate VR Game and / or the Site then:
- The User uses the VR Games and / or the Site at his own risk. The VR Games and / or Site are provided "as is". Joyway does not assume any responsibility, including for the compliance of the VR Games and / or the Site with the goals of the User;
- Joyway does not guarantee that the VR Games and / or the Site meet the User's requirements at the time of acceptance of the Agreement and / or will comply with them subsequently;
- Joyway does not guarantee that the Site and / or the VR game will be free of errors, that defects will be corrected. Joyway disclaims all warranties, express or implied;
- Any information and / or materials (including downloadable software, letters, any instructions and guides to action, etc.) that the User gains access to using the VR Games and / or the Site, the User can use on his own risk and is solely responsible for the possible consequences of using the specified information and / or materials, including for damage that this may cause to the User's computer or third parties, for data loss or any other harm;
- Since the VR Games and / or the Site are at the stage of constant additions and updates, the form and nature of the functionality of the VR Games and / or the Site may change from time to time without prior notice to the User. Joyway has the right, if necessary, at its sole discretion, to terminate (temporarily or permanently) the provision of VR Games and / or the Site (or any individual functions within the VR Games and / or the Site) to all Users in general or to an individual User, in particular, without prior notice and explanation of reasons;
- Joyway is not responsible for any types of losses incurred as a result of the User's use of the VR Games and / or the Site;
- The user agrees and acknowledges that Joyway is not responsible, directly or indirectly, for any bodily and / or psychological injury and material damage that may arise when using the VR Games and / or the Site. But warns, if you, as a User, have contraindications to virtual reality and games in it, then do not play VR Games.
The User and the Company agree that non-pecuniary damage is not subject to compensation.
3.4 If a person has registered as a User on behalf of the authorized company, this means that the company accepts the Agreement and undertakes to protect Joyway, its subsidiaries, management, agents and employees from any legal claims, processes and proceedings related to the use of VR Games and / or the Site, as well as from any liability, including financial, in relation to claims, damage, damage, processes, proceedings, legal costs, attorney fees and any other possible financial and non-financial relationships.
3.5. Joyway is in no way associated with the Content provided and / or posted (including broadcast, if provided by the functional features of the Products) by the Users in the VR Games and / or on the Site, and does not verify the content, authenticity and safety of such Content or its components, as well as their compliance with the requirements of current legislation and that the Users have the necessary scope of rights to distribute and / or use it.
3.6. The User is solely responsible for the compliance of the content of the Content posted by the User with the requirements of the current legislation, including liability to third parties in cases where the User's posting of such Content or its content violates the rights and legitimate interests of third parties, including the personal non-property rights of the authors, other intellectual rights of third parties. persons, and / or infringes on their intangible benefits.
3.7. The User agrees that Joyway is not obliged to pre-check the Content of any kind posted and / or distributed by the User through VR Games and / or the Site, and that Joyway has the right (but not the obligation), at its sole discretion, to refuse the User to post and / or distributing such Content to them or removing any Content that is available through the VR Games and / or the Site. The user understands and agrees that he must independently assess all the risks associated with the placement and distribution of such Content, including an assessment of the reliability, completeness or usefulness thereof.
3.8. In particular, when using the VR Games and / or the Site, the User is not entitled to:
- upload, send, transmit or in any other way post and / or distribute information that is illegal, harmful, defamatory, offends morality, demonstrates (or is propaganda) violence and cruelty, violates intellectual property rights, promotes hatred and / or discrimination of people on racial, ethnic, gender, religious, social grounds, contains insults to any persons or organizations, contains elements (or is propaganda) of pornography, child eroticism, represents advertising (or is propaganda) of sexual services (including under the guise of other services), explains the procedure for the manufacture, use or other use of narcotic substances or their analogues, explosives or other weapons, as well as any other information that may harm third parties or the Company;
- violate the rights of third parties, including minors and / or harm them in any form;
- impersonate another person or representative of an organization and / or community without sufficient rights, including Joyway employees, as well as use any other forms and methods of illegal representation of others on the Internet, as well as introduce users and / or Joyway misleading about the properties and characteristics of any subjects or objects;
- upload, send, transmit or in any other way post and / or distribute Content, in the absence of rights to such actions under the law or any contractual relationship;
- upload, send, transmit or in any other way place and / or distribute not specifically permitted advertising information, spam (including search), lists of other people's email addresses, pyramid schemes, multilevel (network) marketing (MLM) , systems of Internet earnings and e-mail-businesses, "letters of happiness", as well as use the VR Games and / or the Site to participate in these events;
- unauthorized collection and storage of personal data of other persons;
- disrupt the normal operation of the VR Games and / or the Site by any means;
- post links to Internet resources, the content of which contradicts the current legislation of the Republic of Cyprus;
- to facilitate actions aimed at violating the restrictions and prohibitions imposed by the Agreement;
- otherwise violate the norms of the law, including the norms of international law and national law at the location and / or residence of the User.
3.9. In the event of a violation of rights and / or interests in connection with the use of VR Games and / or the Site, including the posting of inappropriate Content to other Users, Joyway should be notified of this by sending a written notification detailing the circumstances of the violation and a hypertext link to the Site page and / or indicate a place in the VR Game by means of a screenshot containing materials that violate the relevant rights and / or interests.
3.10. If there are claims from third parties in relation to the violation of any property and / or personal non-property rights of third parties, as well as the prohibitions or restrictions established by law by a certain User, such User is obliged, upon Joyway's request, to undergo official identification, providing Joyway with a notarized obligation to settle the claims on his own and at your own expense, indicating your passport data.
3.11. In the event that Joyway is brought to responsibility or a penalty is imposed on it in connection with violations of the rights and / or interests of third parties committed by the User, as well as prohibitions or restrictions established by law, such User is obliged to fully reimburse Joyway for losses.
3.12. In case of repeated or gross violation of the terms of this Agreement and / or legal requirements, Joyway has the right to block or delete the User's account, as well as deny access using the account to certain VR Games and / or the Site, and delete any information specified by the User in the Personal Account or Content posted by him without prior notice if there is a Personal Account.
4. Intellectual rights
4.1. All objects available through the VR Games and / or the Site, including design elements, text, graphics, illustrations, videos, computer programs, databases, music, sounds and any other objects, including those recognized as copyright objects under the laws of foreign countries other than the Republic of Cyprus, posted within the framework of the VR Games and / or the Site are subject to the exclusive rights of Joyway, Users and other rightholders.
4.2. Joyway grants the User the right to functional use of the VR Games and / or the Site within their general functionality. The User is granted a non-exclusive, non-transferable, limited license to use one copy of the VR Game for personal, non-commercial use in the ways specified below. Rights not expressly granted by this Agreement are reserved by Joyway.
4.3 Using the VR Games and / or the Site in other ways, including by copying (reproducing) the Content posted in them, as well as design elements, computer programs and databases included in the VR Games, their decompilation, modification, and subsequent distribution, public display, communication to the public is strictly prohibited, unless otherwise provided by this Agreement.
4.4. The User does not have the right to reproduce, repeat and copy (except for the first time when installed on a device), sell, or use for any commercial purposes any part of the VR Games and / or the Site (including the Content available to the User through the VR Games and / or the Site), or access to them, including, but not limited to, use in an Internet cafe, computer game center or any other site linked to a specific location, unless the User has received such permission from Joyway.
4.4.1. The user is not entitled to:
- sell, rent, lease, license, distribute or otherwise transfer VR Games or any copies of a VR Game without Joyway's express prior written consent.
- reverse engineer, source, modify, decompile, disassemble or create derivative works of the VR Game, in whole or in part.
- remove, disable or bypass any proprietary notices or labels contained in or within the VR Game.
- hack or modify (or attempt to modify or hack) the VR Game, or create, develop, modify, distribute or use any software in order to gain (or allow others to gain) the advantage of this VR Game.
-export or re-export the VR Game or any copy or adaptation of the VR Game.
4.5. The User's use of the VR Games and / or the Site, as well as the Content posted in them for personal non-commercial use, is allowed provided that all copyright protection marks, related rights, trademarks, other notices of authorship are preserved, the name (or pseudonym) of the author / name of the copyright holder is preserved. unchanged, keeping the corresponding object unchanged. The exceptions are cases directly provided for by the legislation of the Republic of Cyprus or additional documents for use.

A link (in any form) to any site, product, service, any information of a commercial or non-commercial nature posted within the VR Games and / or the Site does not constitute an endorsement or recommendation of these products (services, activities) by Joyway, except as when it is directly indicated by Joyway.
4.8. By accepting the terms of this Agreement, the User grants Joyway free of charge a simple (non-exclusive) license to use the your Content in the following ways:
- to reproduce the Content, i.e. make one or more copies of the Content in any material form, as well as record it in the memory of an electronic device (the right to reproduce);
- distribute copies of the Content, i.e. provide access to Content reproduced in any material form, including through network and other means, as well as by sale, rental, renting, lending, including import for any of these purposes (distribution right);
- publicly display the Content (the right to public display);
- publicly perform the Content (the right to public performance);
- to communicate the Content in such a way that any person can have access to it online from any place and at any time of his choice (the right to bring it to the public);
- modify the Content, i.e. to alter or otherwise process the Content, including the translation of the Content from one language to another (the right to revise);
- the right to assign all or part of the acquired rights to third parties (the right to sublicense).
4.9. The specified in clause 4.8 simple (non-exclusive) license to use the Content is provided by Joyway simultaneously with the addition of the Content to the VR Games and / or to the Site for the entire duration of the exclusive rights to the objects of copyright and (or) related rights constituting such Content for use in all countries of the world.
4.10. The user guarantees the right to dispose of the Content under the terms of the above license to the extent required. The User undertakes not to send to the Site and / or the VR Game materials that are protected by copyright, trade secrets or otherwise are subject to the property rights of third parties, including patent rights, privacy rights and rights to public use, if the User is not the owner of such rights or does not have permission from their rightful owner to post these materials.
3.1. By accepting the terms of this Agreement, you understand and acknowledge that:
- Joyway has the right to set limits and restrictions on the use of VR Games and / or the Site and the Services based on them for all Users, or for certain categories of Users (depending on the User's location, the language in which the Service is provided, etc.) , including: the presence / absence of certain functions, the maximum storage period for information and data, special parameters of the loaded information, etc.
3.2. Information about the established restrictions will be brought to the attention of the Users in the form and in the manner that are determined at the sole discretion of Joyway.
3.3. Unless otherwise provided by additional documents for the use of a separate VR Game and / or the Site then:
- The User uses the VR Games and / or the Site at his own risk. The VR Games and / or Site are provided "as is". Joyway does not assume any responsibility, including for the compliance of the VR Games and / or the Site with the goals of the User;
- Joyway does not guarantee that the VR Games and / or the Site meet the User's requirements at the time of acceptance of the Agreement and / or will comply with them subsequently;
- Joyway does not guarantee that the Site and / or the VR game will be free of errors, that defects will be corrected. Joyway disclaims all warranties, express or implied;
- Any information and / or materials (including downloadable software, letters, any instructions and guides to action, etc.) that the User gains access to using the VR Games and / or the Site, the User can use on his own risk and is solely responsible for the possible consequences of using the specified information and / or materials, including for damage that this may cause to the User's computer or third parties, for data loss or any other harm;
- Since the VR Games and / or the Site are at the stage of constant additions and updates, the form and nature of the functionality of the VR Games and / or the Site may change from time to time without prior notice to the User. Joyway has the right, if necessary, at its sole discretion, to terminate (temporarily or permanently) the provision of VR Games and / or the Site (or any individual functions within the VR Games and / or the Site) to all Users in general or to an individual User, in particular, without prior notice and explanation of reasons;
- Joyway is not responsible for any types of losses incurred as a result of the User's use of the VR Games and / or the Site;
- The user agrees and acknowledges that Joyway is not responsible, directly or indirectly, for any bodily and / or psychological injury and material damage that may arise when using the VR Games and / or the Site. But warns, if you, as a User, have contraindications to virtual reality and games in it, then do not play VR Games.
The User and the Company agree that non-pecuniary damage is not subject to compensation.
3.4 If a person has registered as a User on behalf of the authorized company, this means that the company accepts the Agreement and undertakes to protect Joyway, its subsidiaries, management, agents and employees from any legal claims, processes and proceedings related to the use of VR Games and / or the Site, as well as from any liability, including financial, in relation to claims, damage, damage, processes, proceedings, legal costs, attorney fees and any other possible financial and non-financial relationships.
3.5. Joyway is in no way associated with the Content provided and / or posted (including broadcast, if provided by the functional features of the Products) by the Users in the VR Games and / or on the Site, and does not verify the content, authenticity and safety of such Content or its components, as well as their compliance with the requirements of current legislation and that the Users have the necessary scope of rights to distribute and / or use it.
3.6. The User is solely responsible for the compliance of the content of the Content posted by the User with the requirements of the current legislation, including liability to third parties in cases where the User's posting of such Content or its content violates the rights and legitimate interests of third parties, including the personal non-property rights of the authors, other intellectual rights of third parties. persons, and / or infringes on their intangible benefits.
3.7. The User agrees that Joyway is not obliged to pre-check the Content of any kind posted and / or distributed by the User through VR Games and / or the Site, and that Joyway has the right (but not the obligation), at its sole discretion, to refuse the User to post and / or distributing such Content to them or removing any Content that is available through the VR Games and / or the Site. 3.8. In particular, when using the VR Games and / or the Site, the User is not entitled to:
- upload, send, transmit or in any other way post and / or distribute information that is illegal, harmful, defamatory, offends morality, demonstrates (or is propaganda) violence and cruelty, violates intellectual property rights, promotes hatred and / or discrimination of people on racial, ethnic, gender, religious, social grounds, contains insults to any persons or organizations, contains elements (or is propaganda) of pornography, child eroticism, represents advertising (or is propaganda) of sexual services (including under the guise of other services), explains the procedure for the manufacture, use or other use of narcotic substances or their analogues, explosives or other weapons, as well as any other information that may harm third parties or the Company;
- violate the rights of third parties, including minors and / or harm them in any form;
- impersonate another person or representative of an organization and / or community without sufficient rights, including Joyway employees, as well as use any other forms and methods of illegal representation of others on the Internet, as well as introduce users and / or Joyway misleading about the properties and characteristics of any subjects or objects;
- upload, send, transmit or in any other way post and / or distribute Content, in the absence of rights to such actions under the law or any contractual relationship;
- upload, send, transmit or in any other way place and / or distribute not specifically permitted advertising information, spam (including search), lists of other people's email addresses, pyramid schemes, multilevel (network) marketing (MLM) , systems of Internet earnings and e-mail-businesses, "letters of happiness", as well as use the VR Games and / or the Site to participate in these events;
- unauthorized collection and storage of personal data of other persons;
- disrupt the normal operation of the VR Games and / or the Site by any means;
- post links to Internet resources, the content of which contradicts the current legislation of the Republic of Cyprus;
- to facilitate actions aimed at violating the restrictions and prohibitions imposed by the Agreement;
- otherwise violate the norms of the law, including the norms of international law and national law at the location and / or residence of the User.
3.9. In the event of a violation of rights and / or interests in connection with the use of VR Games and / or the Site, including the posting of inappropriate Content to other Users, Joyway should be notified of this by sending a written notification detailing the circumstances of the violation and a hypertext link to the Site page and / or indicate a place in the VR Game by means of a screenshot containing materials that violate the relevant rights and / or interests.
3.10. If there are claims from third parties in relation to the violation of any property and / or personal non-property rights of third parties, as well as the prohibitions or restrictions established by law by a certain User, such User is obliged, upon Joyway's request, to undergo official identification, providing Joyway with a notarized obligation to settle the claims on his own and at your own expense, indicating your passport data.
3.11. In the event that Joyway is brought to responsibility or a penalty is imposed on it in connection with violations of the rights and / or interests of third parties committed by the User, as well as prohibitions or restrictions established by law, such User is obliged to fully reimburse Joyway for losses.
3.12. In case of repeated or gross violation of the terms of this Agreement and / or legal requirements, Joyway has the right to block or delete the User's account, as well as deny access using the account to certain VR Games and / or the Site, and delete any information specified by the User in the Personal Account or Content posted by him without prior notice if there is a Personal Account.
4. Intellectual rights
4.1. All objects available through the VR Games and / or the Site, including design elements, text, graphics, illustrations, videos, computer programs, databases, music, sounds and any other objects, including those recognized as copyright objects under the laws of foreign countries other than the Republic of Cyprus, posted within the framework of the VR Games and / or the Site are subject to the exclusive rights of Joyway, Users and other rightholders.
4.2. Joyway grants the User the right to functional use of the VR Games and / or the Site within their general functionality. The User is granted a non-exclusive, non-transferable, limited license to use one copy of the VR Game for personal, non-commercial use in the ways specified below. Rights not expressly granted by this Agreement are reserved by Joyway.
4.3 Using the VR Games and / or the Site in other ways, including by copying (reproducing) the Content posted in them, as well as design elements, computer programs and databases included in the VR Games, their decompilation, modification, and subsequent distribution, public display, communication to the public is strictly prohibited, unless otherwise provided by this Agreement.
4.4. The User does not have the right to reproduce, repeat and copy (except for the first time when installed on a device), sell, or use for any commercial purposes any part of the VR Games and / or the Site (including the Content available to the User through the VR Games and / or the Site), or access to them, including, but not limited to, use in an Internet cafe, computer game center or any other site linked to a specific location, unless the User has received such permission from Joyway.
4.4.1. The user is not entitled to:
- sell, rent, lease, license, distribute or otherwise transfer VR Games or any copies of a VR Game without Joyway's express prior written consent.
- reverse engineer, source, modify, decompile, disassemble or create derivative works of the VR Game, in whole or in part.
- remove, disable or bypass any proprietary notices or labels contained in or within the VR Game.
- hack or modify (or attempt to modify or hack) the VR Game, or create, develop, modify, distribute or use any software in order to gain (or allow others to gain) the advantage of this VR Game.

4.5. 5. Notifications
5.1. Joyway has the right to send the User to the e-mail address specified in his Personal Account or in any other way provided or communicated to the Company, informational e-mail messages (hereinafter referred to as "messages") about important events occurring within the framework of the VR Games and / or the Site or in connection with them.
5.2. Among other things, it is allowed to use messages to inform the User about restrictions on access to the VR Games and / or the Site in connection with preventive maintenance, violations of the User, changes in the functionality of the VR Games and / or the Site, the content or terms of provision of the VR Games and / or the Site, including changes to the Agreement, mandatory and additional documents. The Company leaves it at its discretion to inform Users.
5.3. Joyway, at its sole discretion, has the right to use messages to distribute advertising of its own services and products and / or services of third parties.
6. Account and mail of the User
6.1. Joyway identifies the User by the username and password used by the User specified during registration / or authorization in the VR Games and / or the Site, in the event of any actions taken to use the VR Games and / or the Site, or by the email address used by the User, in the case of Joyway messages received from such an address, or based on information (for example, username) of the User received from third parties.
6.2. Any actions performed using e-mail and / or the login and password of a specific User or the Username of the User received from third parties, are considered to have been committed by such a User.
6.3. The user undertakes to respect the confidentiality of the username and password. In particular, the User does not have the right to transfer his username and password or provide access to his e-mail, information (for example, username) about yourself when registering on third-party resources, to third parties, and bears full responsibility for their safety and individual use, independently choosing the method of storing them and restricting access to them.
6.4. In case of unauthorized access to the login and password, their loss or disclosure to third parties, the User is obliged to immediately inform Joyway about this by sending an e-mail from the e-mail address indicated in his Personal Account. If you have a Personal Account.
6.5. In case of loss or unauthorized access to e-mail, the address of which is indicated in the Personal Account, the User is obliged to immediately replace such address in the Personal Account with a new one and inform Joyway about this fact by sending an e-mail from the new e-mail address. 6.6. In some cases, when applying clauses 6.5 and 6.6, the Company may need to identify the User, which is carried out in accordance with the legislation of the Republic of Cyprus at the location of the User.
7. Final provisions
7.1. This Agreement is governed by and construed in accordance with the laws of the Republic of Cyprus. Issues not regulated by this Agreement are subject to resolution in accordance with the legislation of the Republic of Cyprus. All possible disputes arising from the relations governed by this Agreement are resolved in the manner prescribed by the current legislation of the Republic of Cyprus, in accordance with the norms of law of the Republic of Cyprus. Throughout the text of this Agreement, unless clearly indicated otherwise, the term "legislation" means the legislation of the Republic of Cyprus.
7.2. If, for one reason or another, one or more of the provisions of this Agreement are found to be invalid or unenforceable, this does not affect the validity or applicability of the remaining provisions of the Agreement.
7.3 Joyway's failure to act in the event of violation by the User or other Users of the provisions of the Agreements does not deprive Joyway of the right to take appropriate action to protect its interests later, and does not mean Joyway's refusal of its rights in the event of subsequent similar or similar violations.
7.4. All disputes under the Agreement or in connection with it are subject to consideration, depending on jurisdiction in accordance with the procedural legislation of the Republic of Cyprus.
